RLINGO RENTAL AGREEMENT & TERMS OF SERVICE

This Rental Agreement (“Agreement”) is entered into between R Lingo Motors (“Company,” “Owner,” “we,” “us”) and the individual renting the vehicle (“Renter,” “you”). By reserving, accepting, or operating a R Lingo Motors vehicle, Renter agrees to all terms below.

1. Eligibility & Authorization

Renter must be at least 21 years old (25+ for premium vehicles if applicable), possess a valid driver’s license, provide a valid payment method, and pass identity verification.

Only drivers listed on the rental agreement are authorized to operate the vehicle. Unauthorized drivers void all coverage and result in full financial liability.

2. Payment & Security Deposit

Renter authorizes R Lingo Motors to charge the card on file for rental fees, security deposits, damages, administrative fees, tolls, violations, loss of use, diminished value, and collection costs.

The security deposit is not a damage cap and does not limit financial responsibility. Renter remains liable for damages exceeding the deposit amount.

3. Vehicle Condition & Damage Liability

Vehicle condition is documented at pickup. Renter agrees to return the vehicle in the same condition, ordinary wear excepted.

Renter is fully responsible for collision damage, scratches, dents, windshield damage, tire damage, interior damage, theft, vandalism, mechanical damage due to misuse, towing, storage, diminished value, and loss of use.

Responsibility applies regardless of fault.

4. Prohibited Use

The following are strictly prohibited:

    • Driving under the influence of drugs or alcohol
    • Reckless driving or racing
    • Off-road use
    • Towing
    • Unauthorized rideshare or delivery use
    • Transporting illegal substances
    • Smoking or vaping in the vehicle
    • Removing or tampering with GPS equipment

Violation results in termination of rental, forfeiture of deposit, and full financial liability.

5. Insurance & Assumption of Risk

Renter affirms they carry valid auto insurance or assume full financial responsibility.

If supplemental coverage is declined, Renter accepts full liability for property damage, bodily injury, third-party claims, and legal defense costs.

R Lingo Motors does not provide primary insurance unless explicitly stated in writing.

6. Accidents & Incident Reporting

In the event of accident, theft, or damage, Renter must:

    • Contact law enforcement immediately
    • Notify R Lingo Motors within 2 hours
    • Provide a written incident report
    • Cooperate with investigations

Failure to comply results in full liability.

7. Late Returns & Failure to Return

Late returns may result in additional daily rental charges and administrative penalties.

Failure to return the vehicle may result in repossession, remote disable (if equipped), theft reporting, and legal action.

8. Tolls, Tickets & Administrative Fees

Renter is responsible for all traffic violations, parking tickets, tolls, and impound fees. Administrative processing fees may apply. Charges may be processed after rental period ends.

9. Cleaning & Odor Policy

Vehicle must be returned in clean condition. Excessive dirt, stains, pet hair, smoke odor, or biohazards may result in professional cleaning fees and downtime loss-of-use charges.

Minimum cleaning fee: $250

10. GPS & Telematics Disclosure

Vehicles may contain GPS tracking and telematics systems for security, recovery, speed monitoring, and maintenance purposes.

By renting, Renter consents to tracking. Tampering with equipment results in termination and financial liability.

11. Indemnification

Renter agrees to indemnify and hold harmless R Lingo Motors from all claims, lawsuits, damages, legal costs, and attorney’s fees arising from vehicle use.

12. Collection & Legal Costs

If the account becomes delinquent, Renter agrees to pay collection costs, attorney’s fees, court costs, and allowable interest.

13. Limitation of Liability

R Lingo Motors is not liable for personal injury, property loss, missed travel plans, business interruption, or consequential damages.

Maximum liability shall not exceed rental charges paid.

14. Governing Law

This Agreement is governed by the laws of the State of California. Venue shall be in California courts.

By completing a reservation, the Renter acknowledges they have read, understood, and agree to all terms above.
